Canadian Constitutional Reform, 1927–1982: A Comparative Case Analysis Over Time

What factors account for the successful enactment of a constitutional reform package in Canada in 1982, including patriation, an amendment formula, and a charter of rights and freedoms, after so many earlier failures? Five contributing and mutually reinforcing factors are suggested as principal explanations. These are: shifts in the balance of power between federal and provincial governments; the roles of major economic elites and classes; leadership and personality input; the sequence of options and choices in federal-provincial bargaining; and the changing procedural rules and incentive structures. It must be left to more detailed further study to determine the sequence and mix of these factors in producing the desired outcome.
